Cy Alba is partner with PilieroMazza PLLC.  Mr. Alba practices primarily in the area of government contracts.  Mr. Alba counsels clients in a broad range of government contracting matters, including: overall regulatory compliance; counseling on a wide variety of small business issues, the prosecution or defense of size and status protests/appeals (HUBZone, SDVO, etc.); defense of suspensions and debarments; ITAR compliance and the preparation of technical assistance agreements and/or manufacturing licensing agreements for the export of defense articles and data; the preparation and negotiation of contracts, subcontracts, teaming agreements, and joint venture agreements; the preparation and pursuance of claims and requests for equitable adjustment to a wide variety of federal agencies; and the prosecution or defense of bid protests before the U.S. Government Accountability Office (GAO), U.S. Court of Federal Claims, and the U.S. Court of Appeals for the Federal Circuit.  Mr. Alba also assists PilieroMazza clients with general litigation matters in state and federal courts.

  • Successfully defended against proposed decertifications from the SBA HUBZone program for multiple clients based upon alleged violations of the HUBZone rules and regulations. (unpublished, 2010).

  • Successfully protested agency's failure to set $75 million task order aside for small businesses, see Delex Systems, Inc., B-400403 (Oct. 8, 2008)
     
  • The successful appeal of an SBA finding of affiliation based upon common business relationships after a partial sale of a company.   • The successful protest to U.S. Court of Federal Claims in $50B General Services Administration multiple award Alliant procurement, see Serco, Inc., et al. v. United States, 81 Fed. Cl. 463 (2008)
     
  • The successful protest of awards made pursuant to $630 million U.S. Army Corps of Engineers procurement in Doyon-American Mechanical, JV; NAJV, LLC, B-310003; B-310003.2 (Nov. 15, 2007)
     
  • The successful negotiation of a settlement between the Federal Emergency Management Agency and a contractor regarding services provided after Hurricane Katrina. As a result of the negotiations the total withholding of funds was reduced from $1.3M to $500,000, resulting in an immediate payment of more than $800,000 to the small business joint venture
     
  • The successful closure of a $50M sale of an aerial surveillance company to a foreign buyer, requiring the resolution of various problems relating to the International Traffic in Arms Regulations, Export Administration Regulations, and Federal Aviation Administration's rules and regulations regarding the sale of aircraft's registered in the United States

Prior to joining PilieroMazza PLLC, Mr. Alba was an associate with Saltman & Stevens, P.C. focusing on government contracts litigation including claims, requests for equitable adjustment, bid protests, and other related matters.

Mr. Alba graduated from St. Joseph’s University where he received a B.A., in Philosophy in 2001. He received his law degree, cum laude, from the Catholic University of America, Columbus School of Law in 2004, where he also worked in the General Practice Clinic at Columbus Community Legal Services.

Mr. Alba is currently a member of the Massachusetts Bar, the District of Columbia Bar, the Bar of the United States Court of Appeals for the Federal Circuit, the Bar of the United States Court of Federal Claims, and the Bar of the United States District Court for the District of Columbia.
