Session Description: As part of his goal to “make America great again,” the President has routinely stated his intent to “buy American and hire American.” In an effort to make progress on this front, President Trump signed Executive Order 13788 on April 18, 2017, aimed at tougher enforcement of the “Buy American Laws” which are those laws requiring or providing a preference for the purchase of goods, products, or materials produced in the United States. Given the Trump administration’s intent for stricter enforcement of domestic preference requirements, government contractors need to stay abreast of the relevant laws and regulations, such as the Buy American Act (“BAA”) and the Trade Agreement Act (“TAA”).

Happy Cyber New Year: The Year End Countdown to DFARS Compliance with NIST SP 800-171

Session Description: This session discussed the implementation of NIST SP 800-171 when contractors are subject to DFARS 252.204-7012. Topics included if you need to comply and, if so, what you need to do to implement new security requirements. It also helps to determine if you are already prepared based on the policies and procedures in place.

A strong security program can give you a competitive advantage and avoid many adverse consequences of noncompliance. You want to avoid the “parade of horribles” that could result from non-compliance with NIST SP 800-171 including breach of contract, termination for default, poor past performance assessments, poor proposal evaluations, all the way to False Claims Act exposure and suspension and/or debarment.

If you are not a DoD contractor subject to DFARS 252.204-7012, compliance with NIST SP 800-171 may not be an imminent concern but focusing on cybersecurity should still be part of your New Year’s resolutions for next year.
