Kane advises companies and executives facing civil lawsuits, government investigations, white collar defense matters, and other high-stakes enforcement actions—helping clients manage risk, protect their reputations, and minimize business disruption. He represents individuals and corporate clients in criminal, civil, and internal investigations across a range of industries, including government contracting, employment, energy commodities, financial services, cryptocurrency and blockchain, securities, healthcare, automotive, and transportation.
Kane works proactively with clients to identify and address compliance vulnerabilities before they become costly enforcement actions. When investigations arise, he guides clients through every phase of the process—from responding to subpoenas and civil investigative demands to negotiating with government agencies before, during, and after trial. Furthermore, Kane defends clients in matters before the Department of Justice, the Securities and Exchange Commission, the Public Company Accountability Oversight Board, and state securities regulators. His government experience spans all phases of enforcement, including pre-indictment investigations, charging decisions, trial, and post-resolution compliance considerations.
Kane also assists clients globally with FCPA-related investigations and defends clients against charges of wire fraud, mail fraud, securities fraud, false claims, false statements, identity theft, and environmental crimes. His experience extends to preparing clients for interviews and depositions with government agencies and private parties. Kane is well-versed in responding to agency actions, such as those from the Federal Election Commission, as well as responding to civil discovery. Leveraging his government investigations experience in civil matters, Kane provides clients with confidence that civil litigation will not create unintended criminal exposure.
Kane maintains an active pro bono practice, including assisting in a SEC investigation, as well as a death penalty case. He also helped draft an amicus brief to the U.S. Supreme Court on behalf of 164 Members of Congress in United States v. Skrmetti.
