ATTENTION: IT Value Added Resellers (“ITVARs”)
SBA’s new ITVAR size rule, which went into effect on February 26th, requires ITVARs to comply with the nonmanufacturer rule when reselling IT products to the federal government under NAICS code 541519, footnote 18. This means that for set-aside procurements under NAICS code 541519, footnote 18, ITVARs will have to supply the product of another small business unless SBA issues a waiver or a nonmanufacturer rule exception applies.
We are just starting to understand the practical ramifications of the new rule, and there are many policy issues that need to be resolved or clarified. Given the significance of these issues for the small business ITVAR community, we will be hosting a webinar devoted to this issue on April 12, 2016. The webinar will be presented by partners Jon Williams and Cy Alba. The goal of the webinar will be to explain the new rule and discuss the practical ramifications and policy issues. We intend to take these issues up with SBA soon. First, we would like to hear the thoughts and concerns from the ITVAR community to ensure we get all of the important issues on the table when we approach SBA.
